Supreme Court agreed to deal with Javier Milei’s request for unconstitutionality of DNU

In its resolution, the country’s highest court, chaired by Horacio Rosatti, clarified which will only address the issue starting February 1, when the judicial fair concludes. In this sense, the Court turned the file over to the Attorney General of the Nation, Eduardo Casal, so that he could issue an opinion with his consideration on whether the aforementioned Decree of Necessity and Urgency is constitutional or not.

At the same time, he also sent everything that had happened to the Attorney General of the Treasury, Rodolfo Barra, to make a statement on the issue on behalf of the Government.

This decision will give the libertarian administration a month to carry out negotiations with the other political blocs, with the aim of keeping the DNU in force.

According to Governor Quintela, a precautionary measure was also requested to suspend the effects of DNU 70/2023 and order the Executive Branch of the Nation not to apply any of its provisions until the final resolution of the case.

Its about first request for intervention to the Court made by the DNUbeyond the various protections that are processed before the Justice, especially in the Federal Administrative Litigation jurisdiction.
