This Tuesday, the Government regulated the payment of foreigners non-residents for hospital care. The measure was made official through Resolution 1066/2026, published in the Official Gazette.
Thus, the new regulations join the initiative of some provinces that had already implemented it and formalize what was established by DNU 366/2025, which introduced changes to the Migration Law.
The measure seeks to standardize the charging of services in establishments managed by the National State, differentiating between those who have residence and those who are in transit or with an irregular immigration status.
Who should pay and under what conditions
The regulations, which are based on previous modifications to the Migration Law, establish that foreigners who do not have permanent residence will only be able to access medical treatment or regular health care through:
- Presentation of health insurance
- Prior cancellation of the cost of the service
Meanwhile, permanent resident foreigners will maintain access to the public health system on equal terms with Argentine citizens.
To operationalize the collections, the National Administration of Health Establishments, Ansesand the Ministry of Health They generated two independent administrative circuits:
Financial recovery: Aimed at collecting expenses from Health Insurance companies that cover the patient.
Direct collection: Applicable to foreign individuals who do not count with any type of coverage.
The emergency protocol
A key point of the resolution is the preservation of the right to health in critical situations. The text clarifies that, in cases of emergency, social assistance or health care may not be denied or restricted to any foreigner, regardless of their immigration status or ability to pay at that time.
The measure, which bears the signature of the Minister of Health, Mario Lugones, It comes into effect immediately upon its official publication. With this resolution, the Government aims to “optimize the resources of the public health system and guarantee that the financing of regular health care” is covered by those “who do not contribute permanently to the local system.”
